1. Who these terms are between

These terms are between you and [COMPANY NAME], who runs Palooka. They apply together with the other policies on this site.

2. Who may use it

Palooka is for people aged 18 and over. You confirm your age when you make an account, and we keep the date you did.

3. What credits pay for

Only making is charged. A new fighter made from your photos costs 20 credits. Drawing a fighter again in a new look costs 20 credits. An outfit or a prop of your own, made from your words or a photo of it, costs 5 credits. An arena made from a picture of a place costs 1 credit. One credit is $0.10.

Checking your photos against the strict rule is paid for too. Photos that pass cost nothing more than what they make. Photos it refuses keep 1 credit for the check, once: the same photos sent again are not charged again, and nothing is made from them. Your words are checked for nothing.

Credits are sold in packs, at the prices on the pricing page. Every pack is one payment. Nothing renews, and credits do not expire.

During the beta, a new account starts with 20 credits, enough for one fighter. They are added once, when you confirm your age and agree to these terms, and they are not refunded.

4. Kept fights

You can keep up to 5 fights at a time and send each one as a link. Keeping a fight, watching one and having a video made of it are not charged.

Anyone who has a kept fight's link can watch it. A fight kept after an online fight shows both players' fighters, and either player may keep it. More in the Privacy policy.

A kept fight is removed, with its video, when you delete a fighter that is in it, and when the pictures of a fighter in it are deleted from our servers.

A video is made when our servers are free to make it. We do not promise one for every fight.

5. The market

You can sell copies of an arena, an outfit or a prop you made. Fighters are never sold.

Before your first listing you pick a username. Buyers see it beside what you sell, and nothing else of your account.

Palooka sells its own arenas, outfits and props there too, under its own name.

Listing one costs 2 credits, once, and is not returned when the listing ends.

You set the price, from 1 to 500 credits. Each sale brings you the price less 20%, rounded down; we keep the rest.

The market is in credits only. Credits you earn there can be spent in the game; they are never paid out in money and never refunded.

A buyer keeps their copy for good, also when you take the listing off or delete your account. We may remove a listing that breaks these terms, and suspend an account that keeps listing such things.

6. When credits are spent

The credits are held when making starts and spent only when it is finished. If it fails, they go back to your account by themselves.

7. Paying

Payment is taken for us by Ameriabank. We never see your card.

Inside Telegram, credits are paid for in Telegram Stars and the payment is taken by Telegram.

8. Refunds

Unused credits can be refunded within 14 days of the purchase. Spent credits cannot, and neither can credits we gave you. A pack bought with Telegram Stars is refunded whole or not at all. The whole of it is in Refunds.

9. Photos and consent

Upload only photos of yourself, or of an adult who agreed. Never photos of a minor, and nothing sexual, in the photos or in what you write about the person. Before each fighter is made you confirm this and agree to these terms and to Acceptable use, which says what may be made. We keep the date. More in Likeness and consent.

A picture you upload to make an arena is of a place. The same rule holds for anyone who can be seen in it.

No famous people, and no characters from a film, cartoon, game or comic.

No one under 18.

No nudity, and nothing sexual.

A brand may be named for its style, but no logo, brand name or writing is ever drawn.

That holds for every photo and picture and for every word you write. We check them before anything is made, and refuse what breaks the rule: words for nothing, your photos for 1 credit.

10. Reports, removal and suspension

Anyone can report a fighter made of them. We answer within 3 working days. The fighter can be removed and its owner's account suspended.

11. Leaving

You can delete a fighter or your whole account from the account page, remove an arena from the arenas page and a kept fight from the replays page. A deleted account is gone within 30 days of asking. A copy of your data can be downloaded from the account page.

12. What this draft leaves open

Liability, the governing law and how disputes are settled are not written yet. They are for the legal review.
